JazMaTaz Persians & Exotics (“Breeder”) guarantees that the kitten referenced above is free of the Feline Leukemia Virus (FeLV) at the time of purchase.  The kitten is also guaranteed to be free of intestinal parasites and will have received kitten’s first and second vaccinations and deworming.  It is Buyer’s responsibility to provide kitten with the third vaccination and all necessary vaccinations and adequate health care for the life of kitten.  If Buyer fails to have the vaccinations completed at any stage of kitten’s life, or any evidence of abuse, neglect or mishandling is evident, then this Contract will be immediately null and void.  A copy of kitten’s health veterinary record will be given to Buyer at time of pick-up/delivery of kitten.  In addition, Breeder cannot warrant kitten against any adverse reactions to future vaccinations. 

Before kitten is picked up to go to his/her new family it will be examined by Breeder’s veterinarian.  To the best of Breeder’s knowledge, Buyer is receiving a healthy kitten.  In order to make any claim pursuant to this Contract, Buyer must have Buyer’s licensed veterinarian examine kitten at Buyer’s expense within five days of receiving kitten.  Buyer understands and agrees that failure to have kitten examined by a licensed veterinarian within five days of receiving kitten will cause any and all health guarantees in this Contract to be immediately null and void. 

If Buyer’s licensed veterinarian finds the kitten to have a serious illness or deformity, a written statement by the veterinarian on his/her letterhead identifying the problem must be given to Breeder within the five-day time limit stated above.  The kitten may then be returned to Breeder at Buyer’s expense for a kitten of equal value when one becomes available.  NO CASH WILL BE REFUNDED.  Serious illness means a shortened or painful lifespan.  Breeder is not responsible for the costs of delivering a replacement kitten.  Buyer will make all arrangements pick-up new kitten. 

This guarantee does NOT include minor nuisances such as loose stool, any type of allergies, fungus issues or upper respiratory infections as this can occur as a result of stress due to being relocated into a new home and Breeder cannot guarantee that this will not happen.  However, to the best of Breeder’s knowledge, none of these are present at the time of pick-up/delivery. 

Please note that during times of stress, such as going to a new home, kittens can exhibit temporary signs of illness which may include sneezing, runny eyes and nose, diarrhea, vomiting and or constipation.  To help reduce these issues, Breeder will provide to Buyer dry and wet food that kitten has been eating.  If Buyer decides to change the kitten’s diet, Buyer understands this can cause stress on kitten and kitten may experience diarrhea, constipation or vomiting.  To limit this possibility, Buyer agrees to mix the dry food provided by Breeder with the new food Buyer wishes to feed kitten. Buyer agrees to provide free-feeding of dry food and fresh water at all times. 

Buyer is responsible for all veterinary related expenses once kitten is released from Breeder.  This includes but is not limited to exams, office visits, lab tests, vaccinations, medications, surgery or time off from work.  No medical care is authorized or will be paid for by Breeder.  By signing this Agreement, Buyer is accepting these terms.

If kitten dies within one (1) year of the date of purchase due to hereditary or congenital defects, Breeder will replace kitten with one of similar value.  THERE WILL BE NO CASH REFUNDS.  To determine if kitten’s death has been caused by a congenital or hereditary defect, Breeder must receive proof of the defect in the form of a complete necropsy report, completed by a licensed veterinarian.  Breeder is not responsible for costs related to the necropsy.  If after reviewing the findings by Breeder’s veterinarian and it is determined the death of kitten was under warranty, a replacement kitten of equal value will be offered as soon as possible. 

Breeder does not warrant against FIP.  FIP comes from a mutation of the coronoavirus and the feline intestinal virus (FECV) and no one can pinpoint when or where a cat was exposed to the virus and at what point it mutated into FIP.  Some cats can be exposed and never develop FIP.  The current means of testing for FIP has a high rate of false positives and the only way to know for sure is by necropsy (autopsy).  Also, if you vaccinate kitten against FIP, the test will always come back positive even though kitten may not actually have the disease.  If you choose to vaccinate kitten against FIP, this will cause any and all health guarantees in this Contract to immediately be null and void. 

CFA Blue Slip Registration.  Kittens purchased without breeding rights are sold as “Pet Quality” ONLY and Buyer guarantees kitten WILL NOT be used for stud or breeding.  Buyer agrees to have kitten spayed/neutered by six months of age and will provide Breeder with proof of spay/neuter certificate by six months of age.  Once proof of spay/neuter certificate has been received by Breeder, Breeder will immediately forward the CFA blue slip to Buyer for registration/transfer into Buyer’s name.  CFA blue slip will not be provided until proof of spay/neuter certificate is received by Breeder.  Breeder will pursue all legal action available should kitten be bred without Breeder’s permission.  

Kittens Purchased for Showing.  Breeder does not guarantee “show quality”.  Purchaser is to perform their own due diligence before purchasing kitten regarding acceptable showing standards. 

Kittens Purchased for Breeding.  Breeding rights purchased: __________.  If breeding rights were purchased Breeder does not guarantee kitten will be successful in producing future litters of kittens. 

Under no circumstances will kitten be sold, leased or given to any pet store, research laboratory, breeding mill, or shelter.  If Buyer decides they can no longer care for kitten at any point in kitten’s life, Buyer must return kitten to Breeder.  Buyer will not receive any type of refund.

We strongly discourage declawing of kitten.  Should buyer decide to declaw kitten at any time, all health guarantees/warranties in this contract will be immediately null and void.

Any disputes/claims regarding this contract or kitten will be litigated and governed under the laws of and statutes of Breeder’s home state and county at time of dispute (Marion County, Salem Oregon).

It is agreed that this is an “As Is” sale, subject only to the limited guarantees outlined above which is the final agreement of all parties.  By signing below, you acknowledge that you have read this Contract in its entirety and agree to all of its requirements, stipulations and terms thereof, and that you have received a copy of this Contract for your records.
